Terms of Use

These Terms of Use (“Terms”) form a binding agreement between you and SubLeaseHub Australia (“SubLeaseHub”, “we”, “us”, or “our”) whenever you access or use our platform (the “Service”).

By creating an account, listing a property, submitting an enquiry, or simply browsing the site, you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. If you use the Service on behalf of a company or other legal entity, you warrant that you are authorised to bind that entity.

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

Our platform. SubLeaseHub owns and retains all rights, title, and interest in and to the platform, including but not limited to the website design, software, source code, databases, algorithms, branding, logos, trademarks, service marks, trade names, marketing materials, imagery, layouts, and all other content created or provided by us (collectively, “SubLeaseHub Content”).

SubLeaseHub Content is protected by copyright, trade mark, and other intellectual property laws in Australia and internationally. Unless expressly permitted in these Terms, you may not copy, reproduce, modify, distribute, republish, transmit, display, perform, sell, license, create derivative works from, or otherwise exploit any SubLeaseHub Content without our prior written consent.

Your listings and enquiries. You retain ownership of the content you create and submit to the Service, such as listing descriptions, photographs, logos, and messages sent through enquiry forms ("Your Content"). By submitting Your Content, you grant SubLeaseHub a non-exclusive, worldwide, royalty-free, sublicensable, and transferable licence to use, reproduce, display, modify, adapt, publish, and distribute Your Content solely for the purpose of operating, promoting, and improving the Service.

You represent and warrant that Your Content is accurate, does not infringe any third-party rights (including copyright, trade mark, or privacy rights), and complies with all applicable laws. You must not upload content that is false, misleading, defamatory, offensive, or unlawful.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose: browsing commercial sublease listings, submitting enquiries, and (if registered) creating and managing listings.

This licence does not permit you to:

• scrape, crawl, data-mine, or systematically copy listing information using automated tools;
• remove any copyright, trade mark, or proprietary notices from the platform;
• frame, mirror, or reverse-engineer any part of the Service;
• use SubLeaseHub Content for any commercial purpose not authorised by us;
• reproduce or redistribute our listing database, photographs, or descriptions without permission.

If you believe that your copyright, trade mark, or other intellectual property rights have been infringed by material on SubLeaseHub, or if you discover that someone has copied or stolen our platform material without authorisation, please contact us immediately at the address below.

We reserve the right to investigate suspected violations, remove infringing content, suspend or terminate accounts, and pursue any legal remedies available under Australian law, including seeking damages and injunctive relief for unauthorised copying, distribution, or use of our intellectual property.

Our policy is to respond to clear and valid notices of intellectual property infringement in accordance with applicable Australian law.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorised access.

In using the Service, you must not:

• provide false or misleading information about yourself, your company, or any listing;
• impersonate any person or misrepresent your authority to act on behalf of another;
• harass, abuse, or spam other users;
• introduce viruses, malware, or other harmful code;
• circumvent any security, access control, or usage limitation of the Service;
• use the Service for any illegal or fraudulent purpose.

SubLeaseHub is a marketplace that connects advertisers (sublessors) with prospective tenants (sublessees). We do not own, lease, manage, or control any property listed on the platform.

All listings are created and managed by advertisers. We do not guarantee the accuracy, completeness, availability, or legality of any listing. Any lease, sublease, or licence arrangement is negotiated directly between the parties; SubLeaseHub is not a party to those negotiations or agreements.

You use the enquiry and contact features at your own risk and are responsible for conducting your own due diligence, inspections, and legal review before entering into any commercial arrangement.

SubLeaseHub may offer free and paid listing features. Where fees apply, they will be displayed clearly before you confirm a purchase or subscription, and are quoted in Australian dollars (AUD).

Because paid listing features are supplied and made available immediately, we do not generally offer refunds for a change of mind once a paid feature has gone live. This does not affect your rights under the Australian Consumer Law: if a paid feature is not supplied, is not of acceptable quality, or otherwise fails to meet a consumer guarantee, you are entitled to a remedy, which may include a refund. If something goes wrong with a paid feature, contact us at support@subleasehub.com.au and we will work with you to put it right.

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, SubLeaseHub disclaims all warranties, representations, or guarantees of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, reliability, or uninterrupted access.

We do not warrant that the Service will be error-free, secure, or free from harmful components, or that any listing information is accurate or current.

To the maximum extent permitted by law, SubLeaseHub and its directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claim arising from these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) AUD $100.

Nothing in these Terms limits or excludes any liability that cannot be excluded under applicable Australian consumer law or other mandatory laws.

You agree to indemnify, defend, and hold harmless SubLeaseHub and its directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or relating to Your Content, your use of the Service, your breach of these Terms, or your violation of any third-party right.

We may suspend or terminate your account and access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms, engaged in illegal activity, or otherwise harmed the platform or other users.

Upon termination, all licences granted by you to SubLeaseHub will survive to the extent necessary for us to continue operating the Service (for example, displaying historical listing data as required by law). Provisions relating to intellectual property, liability, and indemnity survive termination.

These Terms are governed by the laws of New South Wales, Australia. Any dispute arising out of or in connection with these Terms or the Service will be subject to the exclusive jurisdiction of the courts of New South Wales.

Before commencing any formal legal proceedings, we encourage you to contact us so we can attempt to resolve the matter informally.

We may update these Terms from time to time to reflect changes in the law, our practices, or the Service. We will publish the updated Terms on this page with a revised “Last updated” date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
